The Course
The NSW Code of Practice: Managing Psychosocial Hazards at Work was introduced in May 2021 and became enforceable through changes to the NSW Work Health and Safety Regulation from 1 October 2022. This marked a turning point: for the first time, employers were explicitly required by law to manage psychosocial risks in the same way as physical hazards.
In practice, this means services must proactively identify factors such as excessive workload, role conflict, bullying, poor support, or exposure to traumatic events, assess the risks, and put controls in place to protect staff wellbeing. For leaders in early education and care, the Code sets a clear expectation: protecting psychological health is no longer optional—it is a core WHS duty, backed by compliance obligations and penalties for breaches.
